1. GUARANTEES AND CONSEQUENTIAL DAMAGES

Guarantees

Quality Containers provides lifetime customer support on all container grades for as long as the original purchaser owns the container.

Container Grades and Descriptions

1) One-Trip (New) Containers
Include a 10-year structural warranty and a 10-year no-leak warranty. These containers have been used only once. Any alterations to the container will void these warranties.

2) Cargo Worthy (CW) Containers
Include a 5-year structural warranty and a 5-year no-leak warranty. These containers are guaranteed to pass the required marine survey inspection for transporting goods via ship or train. This guarantee is valid for 60 days from delivery and is void if any modifications are made to the container. These containers have been used multiple times.

3) Wind and Water Tight (WWT) Containers
Include a 5-year structural warranty and a 5-year no-leak warranty. These containers are of similar quality to Cargo Worthy units but are not guaranteed to pass a marine survey for international shipping. Any modifications to the container will void these warranties.

4) As Is (AI) Containers
This grade of container is not eligible for any warranty.

5) Modified Containers
At Quality Containers, we stand behind our work. All modified containers include a 1-year workmanship warranty, covering the quality and integrity of the modifications we perform. We’ll repair or replace any issues related to welding & structural modifications, door & window installation, interior build-outs, or electrical work completed by our team.  Like most in our industry, the warranty does not cover normal wear & tear or cosmetic issues, rust or aging of the original container, damage from weather, transport or improper setup, or modifications/repairs done by others. Due to the nature of modified containers and environmental conditions, absolute water-tightness is not guaranteed. Minor condensation or moisture may occur and is not considered a defect unless caused by clear workmanship failure.

6) Condition Disclosure
Buyer acknowledges that all container grades may exhibit surface rust, dents, scratches, and prior repairs due to normal wear and tear from international shipping use. Repairs and patches may be present on all grades and even One-Trip containers.
One-Trip containers may show minor cosmetic imperfections such as light dents, scratches, or forklift tire marks from loading and unloading.

7) Cosmetic Conditions
Scratches, dents, rust, and prior repairs do not impact the structural integrity or intended function of the container and are not covered under warranty claims.

Resolution Policy

Quality Containers will repair, or arrange for repair of, any container that does not meet the conditions of its stated grade within the applicable warranty period. This guarantee does not cover cosmetic appearance.

Typical resolutions may include:

  • Repair of the container at no cost if it does not meet grade specifications at time of delivery
  • Reimbursement for pre-approved out-of-pocket repair costs
  • Shipment of an industry-standard permanent repair kit for minor leaks or small holes discovered during the warranty period

Quality Containers stands behind its products and grading standards and will resolve any valid issues at no cost to the customer if a container does not meet its stated grade upon delivery.

These guarantees may not be waived by Quality Containers.

2. WARRANTIES

Limited Workmanship Warranty (1-Year)
Quality Containers warrants that any modifications or fabrication work performed by Quality Containers will be free from defects in workmanship for a period of one (1) year from the date of delivery.

This warranty:

  • Applies only to workmanship performed by Quality Containers

  • Does not cover normal wear and tear, cosmetic issues, corrosion, misuse, improper installation, or modifications made by others

  • Is limited to repair or replacement, at Quality Containers’ sole discretion

Refrigerated Container (Reefer Unit) Warranty Policy

1) New Refrigerated Units

All new refrigerated (reefer) units are sold with the original manufacturer’s warranty. This warranty is provided by the equipment manufacturer and is passed directly to the buyer. Coverage, terms, and duration are subject solely to the manufacturer’s policies and procedures. The buyer is responsible for registering the unit with the manufacturer (if required) and coordinating any warranty claims directly with the manufacturer or an authorized service provider.

2) Used Refrigerated Units (Working Condition)

Used refrigerated units sold in working condition include a limited warranty on the refrigeration unit as follows:

  • Coverage Period: 90 days from the date of delivery
  • Coverage Type: Parts only
  • Labor: Not included; all labor costs are the responsibility of the buyer

This warranty applies strictly to the refrigeration unit’s mechanical functionality under normal operating conditions. Any replacement parts provided under this warranty will be standard OEM or equivalent components, at the discretion of the seller.

3) Exclusions (Reefer Unit)

This warranty does not cover:

  • Labor, diagnostics, or service calls
  • Routine maintenance items (filters, belts, oil, refrigerant, etc)
  • Damage due to misuse, abuse, improper installation or lack of maintenance
  • Electrical issues caused by improper power supply
  • Pre-existing conditions disclosed prior to sale
  • Cosmetic condition or non-operational components not affecting cooling performance

4) Container Structure Warranty

The structural portion of the refrigerated container (including walls, doors, flooring, and overall container integrity) is covered under the same warranty as our standard dry van containers, as outlined in our general container warranty policy.

5) Warranty Claims Process

All warranty claims must be submitted in writing within the applicable warranty period. The buyer must provide:

  • Proof of purchase
  • Description of the issue
  • Supporting photos and/or videos (if applicable)

Seller reserves the right to inspect or request return of defective parts prior to issuing replacements.

6) Limitation of Liability

Under no circumstances shall the seller be liable for incidental, consequential, or indirect damages, including but not limited to loss of product, business interruption, or loss of use.


Disclaimer of All Other Warranties
EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE EQUIPMENT IS SOLD “AS-IS, WHERE-IS.”

Quality Containers disclaims, and Purchaser waives, all other warranties, express or implied, including but not limited to:

(a) Condition, quality, durability, or operation of the container
(b) Fitness for a particular purpose
(c) Compliance with local codes, zoning, permitting, or regulatory requirements

Purchaser is solely responsible for determining suitability of the container for its intended use.


Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER CALIFORNIA LAW:

  • Quality Containers shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or business interruption

  • Quality Containers’ total cumulative liability shall not exceed the purchase price of the container
